And on-coming traffice GENERALLY stays in it’s own lane. Are you going to stop wearing a seat belt based upon that generality? The point here is that the mother of this child is not comfortable with nude pictures of her child floating around out there. They were taken without her consent and now she has to figure out what to do about it. She wants to protect her child’s safety and privacy. It’s not mindless panic. Kerry-Lynn, Before you even call a lawyer I would call the photographer & explain what happened & ask for them or to destroy them in front of you. If they give you a hard time tell them you are prepared to go to a lawyer. If they still wont then I would call a lawyer. The only problem I see with all of this is even if they give them to you or destroy them or if you fight for them in court. How will you ever know that you got them all? I think you & you’re X need to do some serious talking about respecting the other parents wishes. Exactly. I tried it once (first time I had had pro photographs taken, and I didn’t even *think* about fraud, I just needed a couple b+w photocopies in a rush). Kinko’s wouldn’t touch it. I should think ALL pro photographers keep the negatives and the rights. Before getting into too much of a tizzy, Kerry, you should just call – or better go visit — the photographer, explain the situation (NICELY!!!!) and ask for the negs OR to witness him DESTROYING them all. I understand your concern. Have you thought of trying a scare tactic? Go to the photographer and explain that the pics were not something you wanted, had expressely said no nude pics, and if he doesn’t hand over all the negatives you’ll get a court order, etc. Nearly all photogrophers retain the rights to the negatives though. What bothers me is that the photographer would want all rights to the photos. This is not something that happens in your normal kid pics.

I’ve been chewing on this horrible thing since your posting first came in. I am appalled at the poor judgement shown by your X and MIL! But, beyond that I *think* I *might* have the legal angle you can talk to a lawyer about. You are the legal guardian; your X has no rights in that regard. [I live in the US so Canadian law is not my forte.] If a non-custodial individual signed waivers or consents in the US they would not be legally binding. I wonder if it was legal for him to sign those consents/waiver. Also, you say that you were in the process of changing custody to joint with your X. You don’t mention who initiated this or why. I would posit that this event is indicative of your X’s poor judgement, the likelihood that he will not consult you on other important issues [medical care? what your child is exposed to?] and that your parenting styles may be very divergent/not compatible. That’s the law pretty much everywhere – jeeez lady – chill out – 18 month old baby pictures – that’s the most natural thing there is. Do you have ANY reason to believe it was sexual in nature ? If so, he would be REEEEEEEEEEEEEEAAAALLLLYYYY sick. Share what you know. Learn what you don’t.

It’s sad that your ex and MIL would do this without your consent. Have you tried talking to the photographer and getting the negatives? Maybe if you explain the situation to them, they would be willing to. I don’t know what other recourse you would have though, unless you checked with your version of child protective services. <HUGS> to you for what you are going through. Theresea

That is scary!!! I would definitely fight it. You can not trust anyone, you dont know who this photographer is. What kind of grandma would let a stranger keep negatives like that? OH—-MY—-GAWWWWDD! Kerri, I think if I were in your position I’d be talking to my lawyer about this. If you don’t have one, I can only think of Tom Karvanis, in Toronto.
